Group and custom private driver deposits vary and are governed by individual contracts.

FINAL PAYMENTS: Full payment must be made no later than 70 days prior to departure date for vacation packages, self-drive trips and private driver vacations. If payment is not received as scheduled, the reservation will automatically cancel, and the land deposit payment will be forfeited.

CREDIT CARD PAYMENTS: We accept most major credit cards. Travel Agents making payment on behalf of a client must provide us with the cardholder’s information, including billing address and telephone number and must have the cardholder’s signature on file.

EXCLUSIONS: All items of a personal nature (room service, beverages, telephone charges, laundry, etc.) and meals not specified on the tour itinerary are not included in the cost of the tour and must be paid by the client.

TIPS: Tips for personal services and to tour directors and drivers are not included in tour cost and left to the discretion of the traveler.

CANCELLATION PENALTIES:

CANCELLATIONS OR CHANGES: Penalties per person apply: 70 or more days prior to departure forfeiture of deposit; 69-16 days prior 30% per person; 15-8 days prior 50% per person; 7-1 days prior 90% per person; on day of departure 100% per person. If clients cancel from one tour and rebooks on another tour or another date, cancellation penalties will apply. Group and custom private driver cancellations policies vary and are governed by individual contracts.

NOTIFICATION OF CANCELLATIONS: CIE Tours must be notified of cancellations either by phone or via email to helpdesk@cietours.comprior to tour departure. It is the client’s responsibility to ensure that any notification of cancellation is received by CIE Tours and notification shall be deemed to have taken place on the date of receipt by CIE Tours. Minimum cancellation penalty is the deposit amount.

B&B CANCELLATIONS: Any B&B accommodations booked using open B&B vouchers purchased from CIE Tours must be cancelled directly through Bed & Breakfast Ireland’s website or with the homeowners.

AIR BOOKINGS & CANCELLATIONS: Terms of airfare purchased through CIE Tours are governed by each airline’s individual policies. As each airline’s cancellation conditions vary, details should be requested at time of booking, or check the airline’s website for their cancellation policy. In all cases, non-refundable airfare and instant purchase tickets are not eligible for refund.

CIE TOURS CANCELLATIONS: If it becomes necessary for CIE Tours to cancel a trip prior to departure, for reasons outside of a Force Majeure Event, CIE Tours will immediately rebook the guest on a future departure date at no additional land cost or provide a voucher for Future Travel Credit. If CIE Tours cannot provide an alternate date or tour, then a refund may be made.

If it becomes necessary for CIE Tours to cancel a trip due to a Force Majeure Event, CIE Tours will immediately rebook the guest on a future departure date at no additional land cost or provide a voucher for Future Travel Credit. CIE Tours will not be liable and shall not provide a refund for cancellation, delay, rescheduling or other adjustment due to a Force Majeure Event.  CIE Tours cannot accept responsibility for any additional costs or fees related to a cancelled tour booking or for any cancellation penalties, change fees or fare increases related to air.

GUARANTEED COACH TOURS: In the unlikely event that CIE Tours must cancel a Guaranteed Coach Tour, we will offer either the next available date at no additional land cost or 100% refund of all land payments made to CIE Tours.  For air purchased through CIE Tours, we will provide reimbursement for 100% of the air cost.  For air purchased independently, we will reimburse or absorb documented airline penalties/fare changes not exceeding $350 per person.

Travelers specifically agree and acknowledge that these are their sole remedies, and specifically agree not to dispute or challenge credit card or debit card charges related to such travel.

FUTURE TRAVEL CREDITS: Any Future Travel Credits issued will be in the value of the amount paid for the land portion of the trip. The Future Travel Credit is not redeemable for cash under any circumstances but can be transferred to another person.

UNUSED TOUR ARRANGEMENTS: CIE Tours cannot make refunds or exchanges for unused accommodations, services or features of any tour unless agreed upon in writing prior to departure.

VACATION PACKAGES REVISION FEE: Revisions to vacation packages, excluding cancellations and/or tour date changes, can be made after the original booking has been processed but will incur a $50 handling fee per booking in addition to any applicable cancellation penalties. All revisions must be requested at least 30 days prior to departure. Changes to group and custom private driver vacations are governed by individual contracts.

BEFORE YOU TRAVEL

LEGAL NAMES: Traveler names provided must match names listed on traveler passports exactly. Spelling corrections requested after deposit has been applied to the reservation will incur additional fees.

PASSPORTS & VISAS: It is the travelers’ responsibility to obtain the correct travel documentation (passport, visa, identifications) for the destination(s) to be visited. Passports must be valid for at least 6 months beyond the completion of travel.  Please note that due to certain itinerary attractions, CIE Tours must receive guest passport information no less than three months prior to travel. Guest documents will not be mailed until such time as passport information is received.

TRAVEL ITINERARIES/DOCUMENTS: Documents are usually mailed approximately 30 days prior to departure provided full payment has been received. If documents are required earlier, CIE Tours needs sufficient notice to arrange for early delivery by regular service.

TRAVEL PROTECTION PLAN: CIE Tours’ Travel Protection Plan is optional, but highly recommended. When you purchase this Travel Protection Plan within 14 days of the initial deposit/payment for your trip, the CIE Tours’ Travel Protection Plan offered to U.S. guests permits you to cancel your trip up to 24 hours prior to your scheduled departure for a specified reason for cash reimbursement and up to 24 hours before your scheduled departure for any reason not otherwise specified for reimbursement in the form of travel vouchers. The Plan also protects you and your belongings while on your trip. Travel Arrangements must be purchased from CIE Tours to be eligible for reimbursement. Trip protection is non-refundable after 14 days from purchase. Terms and conditions for group insurance vary.

TRAVEL ARRANGEMENTS

ACCOMMODATIONS: CIE Tours reserves the right to substitute hotels for accommodations in similar categories. In the event that a specified hotel in certain destinations is unavailable due to limited hotel inventory, CIE Tours will make every effort to re-accommodate the booking to a hotel of a similar category. When booking pre- and post- stay nights, we provide estimated rates based on standard hotel availability. At the time that the hotel confirms the booking, the rate may increase based on seasonality and availability.

AIR TRANSPORTATION: CIE Tours offers special airfares when combined with our land arrangements. These special airfares are subject to availability and cannot be guaranteed until paid in full. Airfares are inclusive of all fuel, taxes and fees. Client must ensure that the name on the CIE Tours’ invoice matches the passport, as corrections or changes requested after reservation has been made are subject to cancellation or change fees. Airfares are guaranteed once they have been paid in full unless the airfare quoted at time of reservation is instant purchase which is only valid if paid in full and ticketed. CIE Tours is not responsible for penalties incurred for tickets, international or domestic, not issued by CIE Tours due to schedule and/or flight changes.

VISITS, ENTERTAINMENT, ITINERARIES AND OTHER FEATURES: CIE Tours reserves the right to substitute visits, entertainment and other features when establishments are closed or cannot be visited for reasons beyond our control, or for the general convenience of safety of the travelers.

MEDICAL & HEALTH

CIE Tours does not employ medical personnel. Any necessary medical attention must be sought at a local facility, if available, at the guest’s expense. CIE Tours is not responsible or liable for losses or costs incurred due to a required quarantine or other restriction or limitation of travel, unavailability of medical services, or medical services obtained while traveling, or for the quality of the care or services received. You are encouraged to purchase medical insurance that will cover you while traveling as your regular health insurance benefits may not apply abroad.

CIE Tours reserves the right to remove or quarantine any passenger who shows signs of illness, or who poses a threat to the safety and health of other passengers. Removal or quarantine of passengers for any health, safety, or behavior-related assessment is at the sole discretion of CIE Tours. Passengers will be allowed to rejoin CIE Tours with confirmed medical certification from a licensed health practitioner indicating that they are fit to travel without causing harm or posing a safety threat to other passengers.

TRAVELERS WITH SPECIAL NEEDS

Clients who require physical assistance or special accommodations of any kind must advise CIE Tours at time of booking and must travel with a qualified and physically able travel companion to provide such assistance. CIE Tours will make reasonable attempts to accommodate the special needs of disabled travelers but is not responsible in the event it is unable to do so. Neither CIE Tours nor its drivers or guides provide personal services (such as pushing a wheelchair, assisting with walking, etc.) and CIE Tours does not provide individual assistance to a vacation participant for walking, getting on and off motorized coaches, and other vehicles, entering/exiting attractions, or other personal needs. As coaches are not equipped with wheelchair ramps, all tour members must be able to mount 3 or 4 steps into coach. Motorized scooters are unsuitable for the majority of our vacation packages but may be possible for private driver vacations.

If CIE Tours is not notified at time of reservation of any disability requiring special attention, CIE Tours reserves the right to cancel your booking or terminate your vacation if your special needs or disabilities are not suitable for the vacation, pose a threat to the health and safety of other participants or CIE Tours staff, are incompatible with other travelers, or if you are not traveling with a companion who provides all the assistance you require.  CIE Tours reserves the right not to refund or cover any costs or expenses incurred for cancellation, booking, or termination of the vacation.

CIE Tours is not responsible for denial of services by carriers, hotels, restaurants, or other independent suppliers, nor any additional expenses incurred. Due to space restrictions, passengers wishing to take wheelchairs, oxygen tanks or other assistive devices must send a request in writing for approval prior to booking.

In the event any passenger is removed from a trip for any basis including but not limited to communicable diseases, such as COVID-19, CIE Tours has no obligation to refund to that person that portion of the payment allocable to unused services. Each provision of this clause is severable and if any provision is held to be illegal, void or unenforceable in whole or in part, the legality, validity and enforceability of the remaining provisions shall not be affected or impaired. Changes in these Terms and Conditions can be made only in writing signed by an officer of CIE Tours. Prior to full payment there is a potential for a price increase(s) due to fuel surcharges imposed by airlines or other suppliers, as well as the potential for increases in government-levied taxes and fees. Once full payment is made, there will be no price increases. Passengers may accelerate full payment to avoid any price increases. Once issued, airlines tickets are no longer subject to potential increases but are subject to cancellation fees and penalties and may be fully non-refundable.

This Agreement to Arbitrate affects important legal rights. Neither of us will be able to go to court for disputes that must be arbitrated.

TAYLORED TOURS’ TERMS AND CONDITIONS

These terms and conditions (“Terms and Conditions”) govern the relationship between Taylored Tours, LLC d/b/a TayloredTours (“Taylored Tours” and/or “we/us/our”) and you, the purchaser or traveler (“Client” and “you/your”). By planning travel with Taylored Tours, you agree to be bound by these terms and acknowledge that Taylored Tours acts solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”) and is not the source or provider of the travel services. These terms include warranties and disclaimers and exclusions of liability and may restrict your rights and remedies and provide protection to Taylored Tours.

1. USE OF TAYLORED TOURS SERVICES, ACCESS AND INFORMATION FOR TRAVEL BOOKINGS

You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with Taylored Tours. You agree to be financially responsible for all travel bookings you make with us, whether made on behalf of yourself or for other members of your traveling party. You warrant that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with us is true and accurate. You agree that you will only make legitimate reservations or purchases with Taylored Tours and its Suppliers, and you acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited.

Taylored Tours accepts all bookings solely as the booking agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select, and you understand and agree that by booking travel through TayloredTours, you are also agreeing to the booking terms of each Supplier partner you have selected for your itinerary. You agree that you will abide by the terms and conditions of purchase imposed by any Supplier that you have selected as a service provider on an itinerary you have approved.

Taylored Tours is not liable or responsible for any arrangements made independently of Taylored Tours. Taylored Tours assumes no responsibility for costs or fees you incur for independent arrangements not booked through Taylored Tours, inclusive of, but not limited to, airline, hotel, excursion, and travel protection related charges. If you make your own flight arrangements, Taylored Tours is not responsible for any loss resulting from cancellation or changes in international gateways, itineraries, or travel dates, and cannot assist you with any schedule changes or delays related to air reservations you have made on your own arrangement. It may not be possible to earn frequent flyer or other loyalty points for reservations on your itinerary. With limited exceptions, hotel and airline rewards or points cannot be redeemed for travel arrangements made by Taylored Tours.

2. RIGHT TO CORRECT ERRORS AND OFFERS SUBJECT TO AVAILABILITY

We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives and Supplier promotions are subject to availability and may change without notice. You are advised to confirm reservations well in advance of your anticipated dates of travel to avoid disappointment, increases in fares and additional late booking fees. Availability and pricing of services may fluctuate, based on the Supplier’s pricing policies.

3. PAYMENTS, CANCELLATIONS, AND CHANGES TO BOOKINGS

You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through Taylored Tours. By submitting a credit card authorization form to Taylored Tours, you agree to allow Taylored Tours to use your payment method to purchase travel products from our Suppliers on your behalf. All payments for travel are due prior to departure according to each Supplier’s terms and conditions of booking. You understand that failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any flights, tours, hotels, cruises, or other travel services, or in your forfeiting any monies paid for your reservations. In some cases, there is NO REFUND once a booking is made and under deposit. You may not be entitled to a refund if you change or cancel your travel plans after confirmation of a booking. All cancellation requests must be sent to Taylored Tours in writing. As a result of cancellation or changes to confirmed bookings, Taylored Tours's and third-party Supplier’s cancellation penalties will apply. Cancellation fees will be charged to the credit card or other payment method you authorized to pay for travel services or deducted from the Supplier’s refund.

If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you. Certain bookings may not be able to be changed, and you will be responsible for any increases in cost imposed by the Supplier, as well as any Taylored Tours or Supplier change fees. All requests for changes to a booking must be made in writing to Taylored Tours. When tour, cruise or package prices are based on Suppliers’ contract rates, you will not be entitled to any refund for any unused portion of travel.CHANGES TO RESERVATIONS: Any changes made to your existing room reservation are subject to the current rates, promotions, and terms at the time of change. If the number of individuals occupying a room changes, the remaining travelers will be responsible for any additional costs incurred as a result of the change in the per-person occupancy rate. If a traveler makes changes to their reservation, an administrative processing fee of $100 per person will be assessed in addition to travel supplier fees. This processing fee is to cover our time spent processing your reservation change. This fee is per change and will double to $200 per person for changes made within 30 days of travel.

FINAL PAYMENT: The final payment must be received by the due date. If you wish to change the form of payment you must communicate with your travel advisor to ensure payment is made before the due date. If payment is not received by the due date, your reservation is subject to cancellation. Taylored Tours is not responsible for cancellations due to payments made after the due date.

LATE FEES: Final payments not received prior to the due date above will incur a $50 late fee. Payments that are greater than 14 calendar dates late will be charged an additional, incremental $50 late fee. All reservations are subject to cancellation and hotel penalties as described above if final payment is not received on the due date. Late fees are not covered by the travel insurance and are always non-refundable.

CANCELLATION FEE: If a trip is completely canceled, travelers will be charged a $200 administrative processing fee per person booked. This cancellation fee will be charged to your credit card on file by Taylored Tours and it is separate and incremental to any fees or penalties levied by the travel supplier and is to cover the time spent processing your booking and subsequent cancellation.

RESERVATION REINSTATEMENT FEE: If a traveler cancels a trip and wishes to have their reservations reinstated, a $50 administrative processing fee will apply. This is in addition to any supplier fees.

DECLINED PAYMENTS: A $15 fee will apply when a card is declined more than three times for a single payment. If you are using a debit card, please confirm that the proposed charge will be within your daily charge limit and transaction limit. Please contact your card issuer for more details.

4. TRAVEL DOCUMENTS, INCLUDING TSA AND DHS ACCEPTABLE IDENTIFICATION REQUIREMENTS

It is the responsibility of each Client to obtain and carry a valid passport book, visa(s), and all other documents required by applicable government regulations. Passport cards are not accepted for most international travel. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry acceptable identification in order to board a flight. Acceptable identification can be found at http://www.tsa.gov/ and examples include DHS-designated enhanced driver’s license, US passport, or a foreign government passport. Beginning May 7, 2025, you will need a state-issued REAL ID compliant license or identification card, or another acceptable form of ID (such as a passport), to fly within the United States.

Certain countries will not admit a passenger if their passport expires within six (6) months of the anticipated date of return. Non-United States citizens may require additional documentation, and you are responsible to make Taylored Toursaware when traveling on a passport from a country other than the United States of America. Taylored Tours neither controls nor warrants the issuance of visas or approval of visa waivers related to your travel. Should a visa not be issued, TayloredTours is not responsible for lost payments made toward your trip. Please note that rules of each country regarding entry and exit may change at any time.

Children and infants may also require travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities; please see https://help.cbp.gov for additional information. The U.S. Customs and Border Protection Agency requires that for groups of children under age 19 arriving to the United States by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult or group leader in writing.

The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on your tickets and booking records. You acknowledge that it is your responsibility to ensure that the information on your tickets and confirmations is accurate. Any discrepancy between your reservation and your travel documentation may result in denied boarding or an undue delay at an airport security checkpoint causing you to miss your flight, and any subsequent scheduled travel bookings on cruises and tours.

WHEN YOU RECEIVE YOUR TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT TAYLORED TOURS IMMEDIATELY IF CHANGES OR CORRECTIONS ARE REQUIRED. IF YOU HAVE NOT NOTIFIED US OF NECESSARY CORRECTIONS TO YOUR RESERVATION WITHIN TWENTY-FOUR (24) HOURS OF RECEIVING YOUR TRAVEL DOCUMENTS, TAYLORED TOURS BEARS NO RESPONSIBILITY FOR ANY ADDITIONAL COSTS ASSOCIATED WITH MAKING NECESSARY CORRECTIONS.

5. INDIVIDUAL ENTRY AND EXIT REQUIREMENTS

Each country holds different rules of entry for travel, including views of past criminal offenses, whether within or outside of their boundaries, and it is your responsibility to know whether you are eligible to enter the jurisdictions on your itinerary. If you have a current or prior criminal offense, contact that country directly for entry and exit requirements. You can visit the US State Department Website for further information about these requirements. See, https://travel.state.gov/content/travel.html. We do not inquire about an individual’s criminal record in the interest of respecting our Clients’ privacy. For example, if traveling to or through Canada, individuals with a Driving While Intoxicated (DWI) record or with judgements for unpaid child support should review current entry requirements. See: https://www.canada.ca.

In some countries, it is illegal to enter with firearms or ammunition, and if you attempt to enter a country with prohibited items, you may be detained, refused admission, or arrested.

6. IMMUNIZATIONS AND HEALTH SCREENINGS

You must have the proper immunizations and health screenings and required documentation of such immunizations and screenings before travel. Taylored Tours shall not assume responsibility for the accuracy of health, vaccination, or documentation requirements prior to departure or upon landing at the final destination. In some cases, required inoculations must be recorded by Client’s health practitioner on a valid vaccination certificate, which the Client must carry for proof of inoculation. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the State Department Web site http://travel.state.gov, for relevant information relating to travel to specific destinations, and the Center for Disease Control http://wwwnc.cdc.gov/travel/relating to health issues related to travel.

7. RISKS AND SAFETY

Travel to certain destinations may involve greater risk than others. Taylored Tours urges Clients to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on health and safety conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov, and http://www.cbp.gov. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/

BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, TAYLORED TOURS DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CLIENT’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CLIENT’S OWN RISK.

Certain activities that are included as part of itineraries that we book pose inherent risks and may be dangerous. Your itinerary may also involve travel to remote areas without access to medical facilities or treatment, changing weather conditions, interactions or encounters with wildlife, and other potentially dangerous conditions. By booking a trip with Taylored Tours, you acknowledge that you are aware that the physical exertion required to participate in certain activities can activate or aggravate pre-existing injuries, conditions, or congenital defects. You acknowledge that you should seek medical advice if you know or suspect that your physical condition may be incompatible with the activities on your itinerary. You may be required to wear approved safety equipment while participating in certain activities, and by booking travel with us and participating in these activities, you agree to use the recommended safety equipment and to ask questions if you are unsure about how to properly or safely use equipment.

If you use, consume, or are under the influence of alcohol or illegal drugs prior to or while engaging in any activities on your itinerary, YOU ASSUME AND ACCEPT ALL RISKS, DANGERS, AND HAZARDS THAT MAY RESULT INCLUDING THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND LOSS, even in the event of negligence or fault by Taylored Tours or third parties, and you indemnify Taylored Tours from any and all liability for any damage to property or personal injury to any third party, resulting from your participation in the Activities, while, during, or after consumption of illegal drugs or alcohol.

In the event of emergent health or safety concerns, once Taylored Tours has investigated the prevailing situation, Taylored Tours shall have the sole and absolute discretion whether to proceed with any Taylored Tours escorted trip or private departure, or to make alterations to the itinerary.

8. HAZARDOUS MATERIALS

Federal law prohibits passengers from bringing hazardous materials on the aircraft.

(1) Federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radio- active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals.

(2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary. Restrictions on hazardous materials are listed http://www.tsa.gov/traveler-information/prohibited-items.

9. INSECTICIDE NOTICE

We recommend that you refer to the DOT list of airports in countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft. This list is on the DOT’s website and is updated from time to time: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.

10. AIR TRAVEL, SCHEDULE RECONFIRMATION, CHECK-IN

Your airline ticket is a contract between you and the air carrier, even if you purchase through Taylored Tours. If you purchase air travel through Taylored Tours, you acknowledge and agree that Taylored Tours does not have the right to control the operations of independent airlines, and agree that Taylored Tours is not liable for any personal injury, property damage related to your purchase of air tickets or air travel, including, but not limited to any act, error, omission, injury, loss, accident, or delay caused by any act, error or omission of the airline, including their failure to deliver services, partial or inadequate delivery of services, airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy or cessation of operations.

You understand and agree that Taylored Tours functions solely and exclusively as a booking agent for the air carrier, that we do not handle or hold client funds for airline tickets, and that we are not the Merchant of Record under the meaning of that term under the Department of Transportation's regulations. Because Taylored Tours does not hold or handle client funds, you understand and agree that any refund for cancelled or delayed flights, baggage fees or seat assignments must come directly from the airline and not from Taylored Tours.

Taylored Tours shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only, and may vary in price. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares.

Airline e-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise.

Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights.

Frequent Flyer mileage accrual is at the discretion of the airline(s). Taylored Tours has no liability if accrual of miles or points is denied or if upgrades are not allowed. Many airlines do not permit upgrades on airfare purchased in certain fare classes or when using frequent flyer miles, loyalty status or certificates.

Seat assignments are not guaranteed even after they are assigned, and Taylored Tours has no control over airline seat assignments. Most airlines charge a fee to pre book a seat.

11. LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE

Taylored Tours acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. Each Supplier is an independent entity with its own management and is not subject to the control of TayloredTours. The Suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and you consent to the use of those Suppliers.

Some group tours are based on minimum numbers of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed, or the tour may be canceled. Any cancellations of a tour or package for reason of failing to meet the minimum traveler requirement will be governed by the tour operator’s cancellation policy.

Taylored Tours is not responsible if a restaurant, tour operator, cruise line, or other service provider on your tour is unable to or fails to accommodate your dietary restrictions or requirements.

The Supplier may determine that alterations in itinerary are necessary for any number of reasons, including but not limited to severe weather. Any alterations to an itinerary are at the sole discretion of the Supplier, and Taylored Tours bears no responsibility for any changes.

BECAUSE TAYLORED TOURS ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT TAYLORED TOURS IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. TAYLORED TOURS HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND CLIENT AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM TAYLORED TOURS WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY TAYLORED TOURS.

12. FORCE MAJEURE

Taylored Tours will not be in breach of these terms and conditions or otherwise be liable to you, for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, natural catastrophes including, but not limited to extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance which is beyond the control of Taylored Tours. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.

In addition, each of Taylored Tours’s Suppliers have terms and conditions which include Force Majeure provisions. In the event that a Force Majeure event occurs, those Suppliers may be entitled to, and may in their sole and absolute discretion, vary, postpone or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the Supplier pursuant to their policies, although Taylored Tours shall use its reasonable efforts to secure reimbursement for you where possible.

13. CLIENT CONDUCT

Each participant in any trip escorted by Taylored Tours is expected to act responsibly and adhere to all behavior guidelines established by Taylored Tours and our Suppliers, including adhering to dress codes at religious or cultural sites, or Supplier dress codes. Taylored Tours and all local Suppliers reserve the right to remove you from any facility, hotel or resort property, tour location or means of transportation if your health or your conduct appears to endanger yourself or others, disrupts the general well-being of other clients on any element of your trip, or interferes with the operation or security of the places you visit. In any such case, there will be no refund.

When you book with Taylored Tours, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner or manager or other Supplier. You must indemnify Taylored Tours for the full amount of any claim (also including legal costs) made against us. We are not responsible for any costs incurred concerning a guest removed from a trip, or any portion of a trip. You agree not to hold Taylored Tours or any of its related entities liable for any actions taken under these terms and conditions. Baggage and personal effects are at all times the sole responsibility of the participant.

Any transportation, possession or use of illegal drugs will result in immediate termination of your trip and may result in prosecution by law enforcement authorities. You are responsible for knowing and observing the licensing laws for drug possession (including prescription and over the counter drugs) for all countries and states you are visiting. Laws may require you to carry a prescription from your doctor.

The purchase of travel insurance is not required in order to purchase any other product or service offered by Taylored Tours, however if you decline to purchase insurance, Taylored Tours may require that you execute an insurance waiver. Taylored Tours is not a licensed insurance broker, and its advisors are not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. You hereby consent to the exclusive jurisdiction and venue of courts in La Plata County, Colorado in all disputes arising out of or relating to travel bookings with Taylored Tours. Any claim against Taylored Tours must be brought within 12 months after the date of the completion of the trip and not later. Taylored Tours shall not in any case be liable for damages other than compensatory damages, and you waive any right to claim punitive or exemplary damages. If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.
